1. General & Scope
1.1 Provider
drive24, Charlottenstraße 10, 14467 Potsdam, represented by Felix Winkler as a sole proprietorship (hereinafter "drive24"), enables its users to book transport services via its own online platform (www.drive-24.de) as well as by telephone or email.
1.2 Scope of Services
The service of drive24 consists either of carrying out a transport service using its own vehicle or of arranging a transport service with an independent, licensed transport provider (hereinafter "Contractor").
1.3 Applicability of the GTC
The GTC current at the time of conclusion of contract at www.drive-24.de apply to every booking. As no registration is required, the user is obliged to check the current version before each booking. For telephone or written bookings, drive24 keeps the GTC available for inspection; they will be sent to the user upon request.
2. Conclusion of Service Contracts
2.1 Booking Request
By submitting a booking request (online, by telephone or by email), the user makes an offer to conclude a service contract.
2.2 Contract Conclusion
The contract is only concluded upon a confirmation (e.g. by email or verbally by telephone) from drive24.
2.3 Prices
- Taxi: Billing within the mandatory service area is based on the applicable taxi tariff order via the fare meter. Online prices are non-binding estimates.
- Hire car: The fee is agreed individually before the start of the journey (flat rate).
3. Service Offering & Vehicle Types
3.1 Vehicle Types
- Taxi: Transport is carried out with a licensed taxi.
- Hire car: Transport is carried out with a vehicle licensed as a hire car.
3.2 Capacity
Vehicles used offer space for approx. 3 to 4 passengers. Larger vehicles (vans) must be requested explicitly. There is no entitlement to a specific model.
4. Cancellation Policy
4.1 Case-by-Case Decision
drive24 decides at its dutiful discretion on a case-by-case basis whether fees are charged for late cancellation. A right to free cancellation only exists within the following periods:
- Transfer rides: Free of charge up to 3 h before the start. Thereafter up to 50% (up to 1 h before) or up to 100% (less than 1 h before) of the price.
- Hourly bookings: Free of charge up to 6 h before the start. Thereafter up to 50% (up to 2 h before) or up to 100% (less than 2 h before) of the price.
4.2 Right of Evidence
The user reserves the right to demonstrate that drive24 suffered no damage or a significantly lower damage.
5. Waiting Time
5.1 Taxi: Billing in accordance with the applicable taxi tariff order.
5.2 Hire car: 10 minutes of waiting time are included. Thereafter a fee of up to €65.00 incl. VAT per hour may be charged. The user will be informed of this verbally on-site.
5.3 Delays: In the event of a verifiable flight or train delay, waiting time costs are waived upon timely notification.
6. Transport Safety & Obligations
6.1 Luggage & Animals: Excessive luggage or animals must be declared. The driver may refuse transport if there are safety concerns.
6.2 Children: The user is responsible for the required child seats, unless otherwise agreed.
6.3 Soiling: In the event of gross soiling, the user bears the cleaning costs and loss of earnings.
7. Final Provisions
7.1 Liability
drive24 is liable without limitation for intent, gross negligence, and damage to life, body or health.
7.2 Jurisdiction
For merchants, Potsdam is the place of jurisdiction. For consumers, statutory regulations apply.
7.3 Governing Law
German law applies.
